These Terms of Service (“Terms”) govern your access to and use of Gety (“Gety” or the “Service”), provided by Little Carved LLC (“we”, “us”, or “our”). By downloading, installing, or using Gety, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. The Service
Gety is a desktop application that provides local file search and AI integration features. It indexes files on your computer to enable fast search and, when you choose to enable it, lets you connect those files to AI tools and agents. The Service includes the desktop application, our website at gety.ai, related documentation, and any updates we release.
We may modify, suspend, or discontinue any part of the Service at any time. If we make a material change that affects paying subscribers, we will give reasonable advance notice.
2. Account Registration
Some features of Gety require an account. When you create an account, you agree to provide accurate information and to keep it up to date. You are responsible for maintaining the security of your account credentials and for any activity that occurs under your account.
You must be at least 13 years old to use Gety. If you are using Gety on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
3. Subscription, Fees, and Refunds
Gety is offered with a free tier and paid plans (monthly, yearly, and lifetime). Pricing is shown on our pricing page and may change from time to time. Changes to pricing will not affect existing subscriptions until the next renewal.
Payment processing. All payments are processed by Stripe. We do not store your credit card details. By making a payment, you agree to Stripe’s terms.
Subscriptions. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You can cancel at any time through your account settings; cancellation takes effect at the end of the current billing period.
Refunds. We offer a 7-day no-questions-asked refund on all paid plans, including the lifetime plan. To request a refund, email hi@gety.ai within 7 days of your purchase. After this window, payments are non-refundable except where required by law.
Taxes. Prices do not include taxes. You are responsible for any applicable sales tax, VAT, or other taxes.
4. Acceptable Use
When using Gety, you agree not to:
- Use the Service to violate any law, regulation, or third-party right.
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law.
- Resell, sublicense, or redistribute the Service without our written permission.
- Use the Service to transmit malware or to interfere with the operation of any system.
- Bypass usage limits, rate limits, or other technical restrictions in the Service.
- Use the Service to scrape, harvest, or collect information from third parties without authorization.
We may suspend or terminate your access if we believe you have violated these rules.
5. Local Indexing and Your Files
Gety indexes files on your computer to provide search results. All indexing happens locally on your device. Your files, file names, file paths, and file contents are not uploaded to our servers as part of normal indexing or search.
You retain all rights, title, and interest in your files. Nothing in these Terms grants us any ownership of, or license to, your files.
6. AI Integration
Gety exposes a local interface that other software running on your device — such as Claude, Cursor, ChatGPT, or any MCP-compatible client — can use to read content from your indexed files. When you grant such a tool access to Gety, it can request content from your files, including text excerpts, full documents, pages, or other extracts.
Gety itself does not send your data to any AI provider, does not hold API keys for AI providers, and does not act as a proxy or middleman for AI requests. Once content leaves Gety to a tool you have authorized, what that tool does with it — including whether it forwards the content to its own AI provider — is governed by that tool’s terms and privacy practices, not ours. You are responsible for choosing which tools you grant access to and for ensuring you have the right to share any content with them.
AI outputs generated by such tools are produced by models we do not control. They may be inaccurate, incomplete, biased, or misleading, and do not constitute legal, medical, financial, or other professional advice. You are responsible for independently verifying any information generated by AI before acting on it.
7. Intellectual Property
Gety, including its software, design, branding, and documentation, is owned by Little Carved LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. This license terminates when these Terms terminate.
The “Gety” name and logo are trademarks of Little Carved LLC. You may not use them without our written permission, except to refer to our Service in a fair and accurate way.
Where Gety includes open source software, that software is licensed under its own terms, which take precedence over these Terms with respect to that software.
8. Copyright Complaints
We respect the intellectual property rights of others and respond to valid notices of copyright infringement under the Digital Millennium Copyright Act (DMCA). If you believe that content available through the Service infringes your copyright, please send a written notice to hi@gety.ai that includes:
- Identification of the copyrighted work you claim has been infringed.
- Identification of the allegedly infringing material and information sufficient to allow us to locate it.
- Your contact information, including name, address, telephone number, and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
- Your physical or electronic signature.
We may terminate the accounts of users who are determined to be repeat infringers.
9. Third-Party Services
Gety integrates with third-party services, including but not limited to Stripe (payments), Plausible (privacy-friendly website analytics), PostHog (product analytics), Sentry (error tracking), Brevo (email newsletter), Discord (community), and AI tools you choose to grant access to Gety. Your use of these services is governed by their own terms and privacy policies. We are not responsible for the availability, content, or practices of any third-party service.
10. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including without limitation any warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that search results, AI outputs, or other features will be accurate or reliable.
You are responsible for backing up your data. We are not liable for any loss of data, even if such loss arises from use of the Service.
11. Limitation of Liability
To the maximum extent permitted by law, in no event will Little Carved LLC be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service, whether based in contract, tort, statute, or any other legal theory.
Our total liability to you for any claim arising out of or related to the Service will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the claim arose, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.
12. Indemnification
You agree to defend, indemnify, and hold harmless Little Carved LLC and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any content you send to AI providers through the Service.
13. Termination
You may stop using Gety at any time. We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or if we discontinue the Service.
Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, indemnification, and governing law) will continue to apply.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify users by email or by posting a notice on our website. The date at the top of this page reflects the latest revision. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law, Dispute Resolution, and Class Action Waiver
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts.
Informal Resolution. Before filing a claim, you agree to first contact us at hi@gety.ai and attempt to resolve the dispute informally. We will use reasonable efforts to resolve any dispute through good-faith negotiation.
Class Action Waiver. All disputes between you and us must be resolved on an individual basis. You agree not to participate in any class action, class arbitration, consolidated action, or other representative proceeding against us. If this waiver is found to be unenforceable in a particular case, the entire dispute resolution section will be null and void as to that case, but the rest of these Terms will remain in effect.
Time Limit on Claims. Any claim arising out of or related to these Terms or the Service must be filed within one (1) year after the claim arose, or it will be permanently barred, except where applicable law prohibits such a limitation.
16. Export Controls
Gety is provided from the United States and is subject to United States export control laws and regulations. You agree not to use, export, or re-export the Service in violation of any applicable export control law. You represent that you are not located in, and are not a citizen or resident of, any country subject to a comprehensive United States embargo, and that you are not on any United States government list of restricted parties.
17. General Provisions
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Little Carved LLC concerning the Service and supersede all prior or contemporaneous agreements, communications, and understandings, whether written or oral.
Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will continue in full force and effect.
Assignment. You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
Force Majeure. We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, labor disputes, internet or power outages, or failures of third-party service providers.
Notices. We may provide notices to you by email, by posting on our website, or through the Service. You consent to receive notices electronically. Notices to us should be sent to hi@gety.ai.
Waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision. No waiver will be effective unless made in writing and signed by us.
Consumer Rights. Nothing in these Terms limits or excludes any non-waivable statutory rights you may have as a consumer under the mandatory law of your country of residence. Where such law applies, the provisions of these Terms apply only to the maximum extent permitted by that law.
